Persephone Magazine currently has openings for five new featured writers on our staff. Featured writers get a dedicated spot on our schedule every week to showcase their talent, drive, and issues. Are you a writer looking for a platform? A blogger looking to crosspost? A DIYer who wants to share their amazing projects with the world? We want to hear from you.While we welcome any and all inquiries to join our staff, we’re especially interested in writers who cover one or more of the following topics:

What’s new in the world of P-Mag, you ask? Well, we’re being sued.

Here are theA blindfolded unicorn holds a scale of justice in her mouth. (publicly available and legally disclosable) facts, keeping in mind that although the parties involved are a matter of public record, we’re not jerks, so we’re choosing not to disclose any names or identifying details:

  • Persephone Magazine, along with more than 70 other defendants, is being sued for copyright infringement in relation to use of a single photograph.
  • Two separate lawsuits, each relating to the same photograph, were filed by the photographer of said photograph, who is also a copyright attorney. A third lawsuit relating to the photograph was dismissed because the photographer/attorney had not yet registered the copyright for the picture when that lawsuit was filed.
  • Each defendant is being offered the chance to settle the lawsuit for $1500, paid to the photographer/attorney.
  • Many defendants have already settled (although the exact settlement amounts for every defendant have not been disclosed).
  • The photograph was available on several Creative Commons photography sites. No such site is named in the lawsuit. After the lawsuit was filed, the photograph was no longer available on the Creative Commons photography sites, and the photograph in question now features a watermark and right-click protection.
  • The photographer/attorney used a Google Images search to find instances of the photograph in question.
  • P-Mag removed the photograph in question as soon as notice of the lawsuit was received. No cease and desist or DMCA takedown notice was issued before the summons was received. Our first notice of any issue with the photograph was when we received the summons informing us we were being sued.
  • If, as an example, 73 defendants each settled for $1500, the resultant settlement money would amount to $109,500. Subtracting out the court filing fees of $700 ($350 for each of two complaints) results a total settlement amount of $108,800. Attorney fees are not subtracted out since the photographer is an attorney and filed the suit on his own behalf.

Fun, right? We’ve availed ourselves of the best in free legal advice, because (and this may come as a huge shock), P-Mag is not a giant media conglomerate making money hand over fist and employing in-house legal counsel. We rely on donations to barely cover the cost of our server bill every month. Many advertisers don’t like the fact that we write about The Sex, so our ad options are often limited. Our intrepid team of legal advisers have told us that settling for the demanded $1500 is our best bet. Which is all well and good, because being sued isn’t fun and makes us feel icky, but here’s the thing. We don’t have $1500. We have great content, hilarious writers, a witty commenting community, but no money. In fact, $1500 is more than P-Mag made on ads in all of 2012.

So, we need some help. We have legal advice covered already, and we have plenty of opinions about this suit, so although we know everyone loves advice and opinions, we’re all full up on those. What we need is cash, so that we can pay the photographer/attorney the non-negotiable $1500 being demanded and be on our way back to creating great content for you. To that end, we’ve created the P-Mag Unicorn of Justice Legal Fund. If you have a few dollars to spare and to throw our way so that we don’t have to make the choice between settling this matter and continuing to keep the blog up and running, we’d appreciate it more than you can imagine.

Now reading: The Following: A Recap, of Sorts in Pop Culture on Persephone Magazine..

The fabulous chief unicorn and I sometimes get together to live blog premiers of interesting looking shows. But Selena and I could not coordinate a good time for us to watch the new Kevin Bacon thriller, The Following. So instead of a live blog fueled by sweet wine and pull-n-peel Twizzlers, we’re going to share our individual impressions of the new series. Did you watch as well? Join us in the comments. Here thar be spoilers, you’ve been warned.

The Following airs Monday nights on Fox, at 9 p.m.

Selena (who watched first): Cover your eyes when they go to the apartment and tell Kevin Bacon he has to see something. You don’t.

Slay Belle: My dinner just finished. I will watch and eat and think about questions!

Slay Belle: Oh, hey Iceman. Your scruffy beard doesn’t hide the fact that you look like you’re twelve.

Selena: Heh.

Selena: Okay, question the first: Do we need another grizzled white dude former LEO with a monkey on his back?

Slay Belle: Do we think that the babysitter’s visual reference to Rosemary’s Baby was intentional?

Slay Belle: Ok, I was going to ask about the flawed drunken hero too. I’m slightly disappointed that’s the type KB’s character falls into. Its a trope I’m sick of. Its been done to death. I’m not against a flawed protagonist. But the disgruntled-ex-fbi-agent is expected. One of the other character even explicitly says he ‘doesn’t play well with others!’ KB makes good career choices so I’m willing to hold out hope that this is just the surface. But. Still.
The ex-wife on the other hand seems like she’ll be great. I just love her non-flustered approach. The preview clip of her from next week just staring down her ex husband and answering his questions made me like her a lot.

Slay Belle: So what do we think about Sarah being killed off in the first episode? She was obviously set up as a Final Girl and she’s dead before the end of the premier. I’m sure we’ll see her in flashbacks since that seems like it’ll play a big role. But she’s totes murdered.

Selena: Okay, my second question is easy, what would you list as the pros and cons of the show on a whole?

Selena: I was surprised they killed Sarah, and I felt bad for actress Maggie Grace, as some either kills or tries to kill her in every role she plays. I thought it was a bold-ish? move, but after so many years of watching Criminal Minds, I may have a higher shock threshold. I think she’s the only kill What’sHisKiller HAD to make on his own, though. I think the rest of the series is going to be chasing after the members of his cult. No one else could have killed Sarah, and What’sHisKiller couldn’t, I dunno, rest? until he finished the job.

Selena: Also, the kid is totally Kevin Bacon’s. I was unpleasantly surprised at how much plot spoon-feeding went on, under the guise of being Big Mysteries. The way they laid it out couldn’t have been more obvious if they CGI’d Kevin’s face on The Boy.

Selena: Is the ex-wife Penny from LOST?

Slay Belle: Other question while I’m thinking of it: Is the use of Poe as the serial killer’s inspiration just lazy? I love Poe. I was just the other day thinking about getting a Poe tattoo. But he’s mass culture short hand for ‘weird’. I thought maybe the setting would be in Baltimore or Philly to have a thematic tie in, but lol, nope.

Writing: NaNoWriMo, The Third Week | Persephone Magazine

It is almost the end of week three. I wish I could say at this point that things have gotten easier, that my writing is going smoother, and every word I type is pure gold. I don’t need to point out that none of these things are true, right? I have produced one scene that I think is objectively “pretty good” and a lot of stuff that is on the “meh” scale and one or two things that made me pull a face even as I was typing them up. I was encouraged though when I read a post from a published NaNo author (whose website I immediately forgot to bookmark and therefore am paraphrasing) talking about the changes from her rough NaNo draft to the final book – which wasn’t ready for over another year. So I was reminded, again, that I am not married to the words I have written in this race. I am writing to write and to hit my word count. Revision is for December (and January, February, March…)

Recap: The Walking Dead, Episode 2.5, “Chupacabra” | Persephone Magazine

I might be losing my faith in the direction of the show when I say I don’t believe, based on the evidence presented thus far, that the writers have anything interesting to say about gender and social roles in a post-society society. We should have seen something, anything, in any one of the female characters that should have already suggested that they’re interesting in breaking down these kinds of dynamics. Instead we get women slotted into incredibly trite and stereotyped roles – they get to be the mothers, they get to cry, they get to be shrill harpies, and they get to do the fucking laundry. Again. There’s yet another scene where the action surrounds the women doing the fucking laundry while talking about cooking dinner. It would be nice if the show suggested that the women’s time is being wasted doing the fucking laundry instead of learning how to defend themselves or assisting in the hunt for Sophia, but no, not only is this a vital and important part of the group’s survival, no one else can lift a finger to help do it.

Recap: The Walking Dead, Episode 2.4, “Cherokee Rose”

Glenn gets some much deserved screen time, scoping out the farmer’s daughter, climbing into wells to lasso water logged zombies, and making a trip into town with the aforementioned farmer’s daughter.  He even gets a little something-something from Maggie, who is just as lonely and isolated as he is. I might have given Glenn two thumbs up for all his work in this episode if he hadn’t thrown the goddamn tampons back on the floor. It’s the goddamn apocalypse, Glenn! How many pharmacies do you think are going to be out there, zombie free?! WHAT ABOUT THE TAMPONS, GLENN?! WOMEN NEED TAMPONS!
